Copyright

All art, writing, photos, and other content posted on this site or curated through social feeds to this site are copyright and sole property of Erin Blumer, except where expressly stated otherwise.  Use of any content on this site for commercial purposes or personal gain by an individual, organization, or other entity is forbidden, unless written permission has been given by Erin Blumer.  Copyright and fair use violators will be notified, pursued, and potentially prosecuted to the fullest extent of the law.

Social Sharing

Content may be shared on social networks provided that the following are true and prescribed policies are adhered to:

  1. Sharers must be private individuals, or individuals posting on behalf of a non-profit organization. For-profit organizations may not share without first requesting and receiving written permission from Erin Blumer.

  2. Any and all content shared must be shared with a link back to this website, along with a written credit stating that Erin Blumer is the content creator of the given work(s).

Commissioned Works

Ownership of the physical commissioned work is transferred to the individual(s) or organization(s) who requested and paid for the work. Commissioned work may not be reproduced for sale or as a giveaway by either party (unless specified in a separate contract), but the work may be used by either party for non-giveaway promotional purposes, such as advertising.  The same sharing restrictions listed above apply to commissioned work, except that for-profit organizations cannot request the right to use the work, and requests to do so will not be granted.

Privacy

What data is collected?

Your name, email address, and request information are collected when you fill out the commission form.   Physical address information for commissions will only be requested via email, and not through the commission form. Your name and email address are collected when you fill out a form to sign up for the newsletter. Your name, email address, and shipping address are collected when you fill out a form to receive a physical item, such as a holiday card. When you make a purchase, Square and Ecwid collect the information necessary to complete the purchase, including but not necessarily limited to credit card information, items purchased, shipping address, and billing address. All information contained within direct email correspondence is retained. Some browsing data may also be collected.

What will this information be used for?

Information collected via the commission form on this website will only be used for the purpose of fulfilling or responding to requests initiated in the commission form.  This includes ongoing communication for the purpose of fulfilling a request. Physical address information will only be used to fill an individual's requested shipment.

Information collected via a form to sign up for the newsletter will only be used to send periodic emails to the given email address.

No personally identifying information will be shared with third parties, except where the third party provides the means of fulfilling the request or stated purpose of the form (including but not limited to information storage, sending email, or shipping), or to comply with the law.

If an email address or phone number is collected in conjunction with a purchase, the information may be used to provide customer service support in the event that you request assistance.

Information about items purchased is collected for inventory purposes. Information about items purchased may be associated with the purchaser in order to provide a record of collectors and the ability to verify the authenticity of artwork for the purpose of valuation and/or insurance.

Browsing data is used to track trends and provide helpful information about site usability. This data may inform decisions including, but not limited to, how to organize pages on the website and whether any errors need to be fixed.

Where will this information be stored, and for how long?

Information may be stored using Google services, MailChimp, Ecwid, Square, Squarespace, and/or Shutterfly, and it is subject to those services’ privacy and legal policies. Personally identifying information is stored until such time as you request that your information be removed, or until Erin Blumer chooses to remove the information.  To remove personally identifying information, you must provide proof of identity to ensure that the correct information is removed and to protect against fraud. When requested and verified, Erin Blumer will remove all personally identifying information that is accessible to her and under her direct control, within her own systems and within third party systems. However, she is not responsible for removing personally identifying information that is not accessible to her or under her direct control, such as data that may have been stored by a third party and subject to the third party’s policies. For example, on request, Erin Blumer will remove your name and email address from her account in MailChimp, but she cannot guarantee that your personally identifying information has been completely removed from MailChimp’s records or databases, because data entered into MailChimp’s system is subject to their own privacy and legal policies. Upon request, Erin Blumer will provide you with a list of third parties with whom your personally identifying information has been shared, and you may use that list to pursue data removal requests with those parties.
